Gainesville man arrested for breaking into acquaintance’s home

GAINESVILLE, Fla. – Emory Stewart Davis, 22, was arrested yesterday for allegedly breaking into the home of a female acquaintance.
A Gainesville Police Department officer reported that the victim’s boyfriend called at about 8:40 a.m. on August 26 to report the burglary; the officer reported that the victim said Davis, an acquaintance from school, showed up at her residence at about 1 a.m. on August 26 and started banging on the door. She said she did not answer the door, Davis eventually left, and she went to stay with a friend out of fear.
The victim’s boyfriend drove past the victim’s residence the next morning and saw Davis’s car parked in the driveway; he confronted Davis, who reportedly said he had broken into the residence. When the victim’s boyfriend called 911 to provide a description and tag number for the vehicle, Davis reportedly left.
An officer conducted a traffic stop on Davis’s car near Wawa (1007 E. University Avenue), and Davis reportedly stated spontaneously that he had broken into a residence.
The arresting officer reported that a broken window was found on the side door, and when officers conducted a safety sweep of the residence, they found small dried droplets of blood on the floor throughout the house.
Post Miranda, Davis reportedly said the victim told him to break into her residence, and when he arrived at the residence, he punched the window in the side door. He said he went in the side door, looking for the victim, and once he realized she was not there, he swept up the broken glass and left.
Davis has been charged with burglary of an unoccupied dwelling. He has no criminal history; Judge Meshon Rawls ordered him held without bail pending a hearing on a motion from the State Attorney’s Office to hold him without bail until trial; if the judge denies the motion, bail will be set at that hearing.
