Frazer School wins preliminary injunction against eviction

GAINESVILLE, Fla. – The Frazer School today secured a significant legal victory when Chief United States Bankruptcy Judge for the Northern District of Florida, the Honorable Karen K. Specie, granted a preliminary injunction protecting the school’s rights to its building at 4700 NW 89th Boulevard, Gainesville, Florida. Today’s success means the Frazer School proceeds confidently into its third year. The school’s nationally recognized math competition teams — fresh off another championship season — are ready to get back to work, and the dedicated staff, faculty, and administrators look forward to welcoming their students back in just a few short weeks.

Judge Specie carefully considered all four factors required under Eleventh Circuit law for preliminary injunctive relief, and found in the Frazer School’s favor on each. The Court relied primarily on the December 17, 2025 School Transition and Asset Purchase Agreement between the parties, with sworn statements, submitted by the Defendants Newberry Christian Community School, James R. Schrader, and Rachel E. Schrader themselves, providing additional support for the Frazer School’s position.

The ruling enjoins the Defendants from further transferring, dissipating, mortgaging, or otherwise encumbering the building while the adversary proceeding continues.

Pro bono Bankruptcy Counsel Steven M. Berman of Shumaker, Loop & Kendrick reflected that “for the Frazer School community, today’s ruling means one thing above all else: The Frazer School remains in its home.”

The students, teachers, and families who have stood by this school through extraordinary circumstances have been heard and protected. The Frazer School’s mission — providing exceptional education to curious and academically passionate students — continues.

The Court will consider further evidence at a trial scheduled for 10 a.m., Tuesday, August 18, 2026, in Tallahassee.
