Colorado man arrested for climbing in window of ex-boyfriend

GAINESVILLE, Fla. – Abian Isaiah Gutierrez, 21, was arrested early this morning and charged with burglary of an occupied building after allegedly climbing through a window and then pushing into a bathroom where his ex-boyfriend had taken refuge.
A Gainesville Police Department officer responded at about 4:25 a.m. to a call from the victim, who had been arguing with Gutierrez, a former boyfriend who was visiting from Colorado, inside his apartment; Gutierrez left the apartment but returned a short time later and allegedly started banging on the door, yelling for the victim to let him back in. The victim called 911 and was advised to go inside the bathroom.
Gutierrez allegedly removed the window screen and entered through an open window, then pushed his way into the bathroom and began yelling at the victim.
Post Miranda, Gutierrez reportedly denied entering through the window and said that the victim let him back in.
Gutierrez has no criminal history; Judge Thomas Jaworski set bail at $2,000.
