Gainesville man arrested for e-bike theft, illegally carrying concealed BB gun

GAINESVILLE, Fla. – Tyree Cortez Oliver, 25, was arrested early yesterday morning and charged with stealing an e-bike, possession of a controlled substance, and carrying a concealed weapon as a convicted felon.
A Gainesville Police Department Officer made contact with Oliver at about 4:55 a.m. on Friday morning because he was reportedly pushing an e-bike in the middle of SW 13th Street, where there were sidewalks available.
The officer reportedly asked Oliver if he had any weapons, and Oliver reportedly said he had an airsoft BB gun in his pocket. Oliver reportedly said he often walks through the woods and uses it “to kill squirrels.” The officer reportedly found a black Beretta 4.5 mm BB pistol.
The e-bike had been reported stolen on March 25.
Post Miranda, Oliver reportedly said he purchased the bike from a Facebook Marketplace seller about four months ago, but he was unable to provide any documentation of the sale. He later reportedly said he bought the bike about a week ago but was also unable to document that sale.
A search incident to arrest reportedly produced about 0.5 grams of MDPV (“molly”).
Oliver has been in Alachua County since about 2017 and has 10 felony convictions (none violent) and three misdemeanor convictions (none violent). He has served two state prison sentences and was released in December 2022. He is being held on $80,000 bail.

Looking at his court records I discovered that he had some of these felony convictions while a student in my class and I was never informed. Disgusting

I’m not trying to defend this guy, but I am interested. As far as I know, BB guns are not firearms by state law. Is there a law against carrying concealed CO2 paintball or air powered BB/pellet guns in Florida? I understand of course that such BB/pellet guns should not be fired at a person, but do laws about how real firearms may be carried apply to BB/pellet guns?
Any device that fires s projectile is considered a weapon . Flare gun, dart gun, spear gun. BB gun. If you are a felon, you are not allowed to protect yourself, even if you were a felon for weed possession

FWC should sight him for hunting without a license and taking squirrel out of season. That is a lame excuse for having a BB gun that resembles a real gun at 4:55 AM.
What is ridiculous is the law that prohibits a felon from having a BB gun. It is easily recognizable as non lethal by the red banding. What is more ridiculous is the fact I’m a Vietnam Vet, was paid to kill, but in 1980 was convicted of marijuana possession and now I can’t legally own a BB gun.
Well thank you for your service to start with. I am sorry you made a choice in 1980 to break the law and preclude from your rights to own a BB gun or Firearm. The ridiculous part if this whole thing is that he has 13 convictions, and two prison terms and still is walking around at 5 AM with a stolen E Bike. I dont think he can say he was hunting squirrels at 5 AM in the dark. Raccoon or opossum may have made a better story. And he had the BB gun which the arrest report doesn’t say if it was orange capped or not. And a lot if these Chuckleheads remove the caps so people think its real. All I know is that my license says if he would pointed that thing at me he would be at the ME office waiting for Chestnuts to pick him up.
