GAINESVILLE, Fla. – Shammari Dewayne Russell Tolbert, 21, was arrested on Friday for an October incident in which he allegedly pointed a gun at two women.
At about 5:25 a.m. on October 30, Tolbert was in the first victim’s apartment at Gardenia Gardens (1725 NE 8th Avenue), where he was assisting with caring for the first victim’s infant. The first victim told a responding Gainesville Police Department officer that she was in her room with the baby when Tolbert broke through the locked door and started yelling at her. She said she ran to the second victim’s apartment for help, leaving the baby asleep.
The two victims knocked on the door of the first victim’s apartment, telling Tolbert to give them the baby, and Tolbert allegedly came outside with a handgun and pointed it at both women. The second victim called the police, and Tolbert reportedly ran back inside the apartment and locked the door. Both victims said they were afraid Tolbert would kill them when he pointed the gun at them.
The victims provided a description of the gun, and the officer noted that Tolbert had made an Instagram post about 15 hours earlier that showed him with a handgun.
At the time the sworn complaint was written, Tolbert was still inside the apartment with the baby. He is facing a second sworn complaint for aggravated assault with a deadly weapon, three counts of armed burglary, and two counts of child abuse without great bodily harm, but the sworn complaint has not been uploaded to the court’s website.
Tolbert has been charged with two counts of aggravated assault with a deadly weapon. He has no criminal convictions. Judge Jonathan Ramsey ordered him held without bail pending a hearing on a motion from the State Attorney’s office to hold him without bail until trial. On December 9, Judge David Kreider denied the motion and set bail at $100,000, with a requirement for a GPS monitor and a prohibition against contact with the victim and unsupervised contact with minors.
Articles about arrests are based on reports from law enforcement agencies. The charges listed are taken from the arrest report and/or court records and are only accusations. All suspects are innocent until proven guilty in a court of law.
