Gainesville man charged with raping and choking woman

GAINESVILLE, Fla. – Jose Daniel Cediel Marin, 63, was arrested yesterday and charged with sexual battery and battery by strangulation.

The responding Gainesville Police Department officer reported that the victim said she was at Cediel Marin’s residence when he looked at her in a sexual way that made her feel uncomfortable, so she called her sister. The victim said Cediel Marin walked over to her and started kissing her; she said she did not kiss him back because he is married.

The victim told the officer that Cediel Marin led her to a bedroom, raped her, and choked her. She said she yelled at him to stop, but he ignored her and raped her a second time. She said that when he was done, he got ready for work, and she called her sister, who told her to call the police; the police arrived as Cediel Marin was leaving for work.

The officer reported that the victim had redness near her collarbone and neck, and she reportedly told the officer that she never gave Cediel Marin permission to have sex with her.

Post Miranda, Cediel Marin reportedly said the victim had been upset about a project that wasn’t working out, and he had offered to help her with it when he got home from work. He said the victim kissed him first, and he declined her advances and then got ready for work. He denied ever having sex with, kissing, or hugging the victim in any way. He said he does not need to have sex with the victim because he is married.

Cediel Marin, who is from Colombia but is a United States citizen, has been charged with sexual battery and battery by strangulation. He has no local criminal history, and Judge Bo Bayer ordered him held without bail pending a hearing on a motion from the State Attorney’s Office to hold him without bail until trial. On May 7, Judge James Colaw granted the motion and ordered him held without bail until trial.
