Gainesville man sentenced to 90 days in jail, 3 years of probation after pleading nolo contendere to shooting another man

GAINESVILLE, Fla. – Frank Anthony Hargitt, 63, has been sentenced to 90 days in jail with credit for 38 days served, followed by three years of drug offender probation, after pleading nolo contendere to aggravated battery with a deadly weapon and drug possession.
Gainesville Police Department officers responded to a report of a shooting in the 3200 block of SW 26th Way on March 28 at about 1:20 p.m. and found a victim with a gunshot wound in his buttock. The victim’s injuries were reported to be non-life-threatening.
A witness told officers that he heard one gunshot, ran outside, and saw Hargitt standing over the victim with a gun. The witness said Hargitt told him he didn’t intend to kill the victim but he was tired of being harassed.
Another witness said Hargitt had left the house to go to the store, but he came back after about seven minutes, said “I shot him,” and put the gun on the couch.
Post Miranda, Hargitt reportedly said, “I didn’t want to kill him so I shot him low.” He said the victim had been standing on his front porch and had lunged at him; he then armed himself with a gun, chased the victim around the corner of the house, and shot him.
A charge of possession of a controlled substance without a prescription was added later after Hargitt reportedly admitted that he had “molly” in his pocket.
The plea agreement, signed by Judge Phillip Pena, states that the maximum sentence for the charges is 20 years in state prison; under the agreement, adjudication of guilt was withheld. Assistant State Attorney Rich Chang was the prosecutor in the case.
He get 90 days in jail for shooting someone and some of the j6 political prisoners get years in prison for strolling thru the White House that our tax dollars pay for and that belong to legal citizens of this country.
It was the Capitol building, not the White House numbnuts, and they weren’t strolling, they were causing a riot and insurrection against the government and hurting police officers that in another country would have gotten them the death penalty. All you fascist republicans are seriously mentally ill and belong locked up in asylums.

Although it’s a very soft punishment, this reads like a possible stand your ground case. Easy to put doubt in a jurors mind, which makes conviction in trial hit or miss.
Sometimes the plea is the best option for the state.
I don’t see it that way if you have to get a gun then chase him down and then shot him as his back it to you.
What in the hell is this world coming to?!?!?! Shoot somebody n get 90 daysssss!!! He wasnt in imminent danger he chased the man around the house!! Our legal system has gone to crap, people do anything these days and get away with it.

He was being harassed so it’s stand your ground, according to Florida law. The so called victim got what he deserved. He should have left Hargitt alone.
He should be doing 5 years. He was not in fear for his life, if he was, he would have killed him.
Technically, it’s not self defense when you shoot em in the ass. lol
This happened in the Phoenix neighborhood, what I would call a high crime/low income area. This is what I call reactionary crime. There is someone (same situation) I am helping Mr. Andre Abrams. He was a NE Gainesville resident who took his fire starter to some G.I.T.S to scare them from the vicinity of his residence. The papers and officer Perez made these “victims” out to be homecoming king & queen. Well one of three is on state for the next 30-40 years. 137 shots fired, nine wounded 2 homicides in a GAINESVILLE HOUSING AUTHORITY project.
Now after the first ADA did nothing for over a year the newly assigned ADA all of a sudden makes five plea bargain offers by ADA Pickens to get GPD out of a bad arrest has declared the man incompetent to stand trial because of bipolar 1 disorder… YOU can look this all up on the clerk of court.
I lived in HOLLY HEIGHTS & I had similar experiences as well I can quote several other examples. We all tried to get help from impotent authorities…

There’s a convicted pedophile who unfortunately lives in my neighborhood. I’ll go to his house & cap him right away, if I can secure a deal of only having to do 90 days for it!!
