Hawthorne man arrested for threatening to shoot driver after car crash

GAINESVILLE, Fla. – Andrew Manuel Cabeza, 38, of Hawthorne, was arrested yesterday for allegedly threatening to shoot a man after a crash and then following him to a construction site, where he allegedly threatened to shoot people there; Cabeza was reportedly warned about a week ago that he could go to jail for threatening to shoot other drivers.
On July 10, a Gainesville Police Department officer responded to a construction site near the intersection of SW Archer Road and SW 37th Boulevard, where the victim said Cabeza had threatened to shoot him after a crash at about 12:20 p.m.
The officer reported that dash cam video from Cabeza’s car showed the crash, and nearly immediately after the crash, Cabeza can be heard outside the vehicle, screaming, “I will shoot you” at the victim.
The victim reportedly drove to the construction site, about two blocks from the crash, because he was in fear for his life, but Cabeza allegedly went to the construction site and pointed his gun at some of the construction crew and said he would shoot them. Cabeza was reportedly pulled away from the construction site by his brother, and the crew at the construction site reportedly did not want to be victims of a crime.
A search incident to arrest reportedly produced a CO2-powered air pistol that looks like a real firearm “and could cause great bodily harm or death,” according to the arresting officer.
Post Miranda, Cabeza reportedly admitted that he had jumped out of his vehicle and pulled his gun, saying he would shoot the victim. He reportedly said at first that he did this because the victim was leaving the scene of the crash, but he later said he thought the victim was going to run over his brother. The officer reported that the victim did not back up his vehicle or attempt to leave until Cabeza pulled a gun on him.
The officer reported that another officer had spoken to Cabeza about a week ago after a similar incident in which Cabeza thought someone was driving too aggressively and pulled the same gun on that person while driving in traffic. The officer said he warned Cabeza that he could go to jail for pointing a gun at someone, but the other driver did not want to be a victim of a crime, so he was not arrested. The officer reported that he talked to Cabeza “extensively, cautioning him of his behavior due to the fact that someone could have a real gun and could harm him, as well as the possible legal ramifications of his actions.”
Cabeza has been charged with aggravated assault with a deadly weapon. He has an unspecified criminal history in another county between 2006 and 2014, but no local criminal convictions. Judge Denise Ferrero ordered him held without bail pending a hearing on a motion from the State Attorney’s office to hold him without bail until trial; if the judge denies the motion, bail will be set at that hearing.

The story is false I have different footage from the scene collaborating a different instance than the public police report. Also I was passenger of the vehicle hit. I also have footage before we met the intersection where other trucks appear to blow the same stop sign. It must be nice to put together a bunch of public information without understanding the full scope of the situation, But I guess we’ll wait for the judge to make this decision. I was with the driver of the truck negotiating the instance of the crash Paula, sorry I couldn’t jump right in front of my brother like your protruding. I never pulled my brother from the construction site nor did he take my disable father up to that site or brandish any replica firearm there. My fathers Dash cam footage show’s what a “Dressed” up police report should look like, personally my family has been through enough of this and to be frank Andrew has a brother that can think faster than any gator. You’re full of crap. I was in traffic at the light at the bottom of the hill and saw the commotion behind me with the red dump truck. Saw that psycho get out and brandish his gun while the dumptruck driver was getting out. He ran toward the truck in an aggressive manner yelling and screaming and if he did that to me in my truck I can tell you I would have emptied the mag into him. Luckily the light turned green and I didn’t see any reason to intervene since I’m actually a responsible gun owner and it didn’t have anything to do with me or my family. Lucky for your brother.
