High school student arrested for unlawful firearm possession

GAINESVILLE, Fla. – Jose Luis Silverio Diaz, 18, was arrested early this morning for possession of a firearm by an adjudicated delinquent.

At about 2:47 a.m. on March 31, a Gainesville Police Department officer saw a car run a red light at the intersection of SW 16th Avenue and SW 13th Street; the car also reportedly did not have a functioning tag light, and a traffic stop was conducted.

The officer reported that Silverio Diaz was alone in the vehicle; he saw Silverio Diaz fumbling under his seat and heard what appeared to be metal-on-metal contact. The officer ordered Silverio Diaz to put his hands up and out of the window; Silverio Diaz complied and was removed from the vehicle.

An officer reportedly saw part of a pistol under the front driver’s seat, and a Glock 22, loaded with 19 rounds of .40 caliber ammunition, was reportedly found under the seat.

In 2021, as a juvenile, Silverio Diaz was adjudicated guilty of burglary of a vehicle, and he is not permitted to possess a firearm until he is 24 years old. According to court documents, he currently attends a charter school that helps high school dropouts earn a diploma.

Silverio Diaz has been charged with possession of a firearm by a delinquent under 24 years of age. He has juvenile convictions between 2021 and 2025, but no adult criminal convictions; he completed his probation in the 2021 case in August 2025. Judge Adam Lee set bail at $50,000.

  • It sounds às if he has moved forward but for this. However what’s a person doing out at 2:30 in the morning? Sounds as if the charter school could teach some life skills. Like how to take care of yourself. How to set a bedtime and wake time to have the focus to get up in the morning at a reasonable time and attend to responsibilities. People need life skills.
