Illegal alien arrested for attempted burglary of occupied home

GAINESVILLE, Fla. – Jose Roblero Hernandez-Perez, 21, of Mexico, was arrested early this morning for allegedly trying to enter a neighbor’s home while she was inside with her child.

At about 3:30 a.m. on August 15, a Gainesville Police Department officer responded to a home near the 900 block of NW 39th Avenue, where the victim said there was a “Mexican man” trying to open her front door.

The victim said she had arrived at her residence in an Uber, and after she took her child inside, she heard someone “laying on the horn” of a vehicle outside. She said she opened her door because she thought the Uber driver might have been trying to get her attention, but she saw a different vehicle with a Hispanic driver. She said the man asked her, “Do you work?”, which she interpreted as referring to prostitution.

The victim said she closed the door, and the man walked up to the door and tried to open it, so she called 911; the man fled when the officer arrived.

The victim said she was in fear because her child was inside the residence and the man was trying to get inside.

A witness reportedly said she had also arrived in an Uber and entered the residence with the victim, and then she heard someone beeping a horn outside; she said she saw a man in a vehicle, and after the victim closed the front door, the man tried to open the door by turning the knob.

Hernandez-Perez was reportedly found hiding behind a small bush near the victim’s home. Post Miranda, Hernandez-Perez reportedly stated in Spanish that he is from Chapas, Mexico; he said he tried to enter the victim’s residence because the victim snatched $50 from him after offering him sexual acts. He said he hid from the officer because he was afraid the officer was an immigration officer.

Post Miranda, both the victim and witness denied taking money from Hernandez-Perez or offering him sex.

The officer reported that he was not able to positively identify Hernandez-Perez because he is an illegal immigrant from Mexico.

Hernandez-Perez, whose listed address is near the victim’s residence, has been charged with attempted burglary of an occupied dwelling. He has no local criminal history, and Judge Gloria Walker ordered him held without bail pending a hearing on a motion from the State Attorney’s Office to hold him without bail until trial; if the judge denies the motion, bail will be set at that hearing.
