Jacksonville man charged with date rape

ALACHUA COUNTY, Fla. – Albert Charbine, 33, of Jacksonville, was arrested yesterday and charged with raping a woman on their first date.

An Alachua County Sheriff’s Deputy reported that on March 3, the victim met Charbine at a Tioga restaurant after setting up a date on Tinder. The victim reportedly provided text messages from before the date in which she told Charbine she was not interested in engaging in sexual intercourse right away.

While at the restaurant, the victim began experiencing symptoms like tingling in her arms, weakness, and a loss of control over her body, and she initially attributed this to a “cluster migraine.” She told Charbine she needed to go home, and Charbine offered to drive her home, but she decided to drive her own car; she said Charbine insisted on making sure she arrived safely at home, and the victim decided to compromise and allow him to follow her home in his vehicle.

When they got to the victim’s residence, the victim said she felt disoriented and unable to maintain her balance, and Charbine entered her residence with her. Once inside, Charbine allegedly started kissing her, and she said she pulled back and told him she did not feel well and did not want to engage in any sexual activities.

Charbine allegedly followed the victim into her bedroom when she went to change her clothes, although she told him to go back to the living room. She said that he refused and sat down on her bed, so she moved out to the living room, where he sat next to her and allegedly escalated his actions until he eventually raped her in spite of her repeated statements that she did not want to engage in sexual activity with him. The victim said she did not fight back physically because she believed Charbine would harm her.

The deputy reported that after Charbine left the victim’s residence, the victim sent him a text message saying she felt violated, and Charbine responded, “Did you have any fun at least?”

Charbine was arrested at UF Health Shands on March 9. Post Miranda, he did not want to answer any questions.

Charbine has been charged with sexual battery. He has no criminal history in Alachua or Duval counties, and Judge Susan Miller-Jones ordered him held without bail pending a hearing on a motion from the State Attorney’s Office to hold him without bail until trial. On March 18, the State Attorney’s Office notified the judge that they would not seek pre-trial detention, and Judge William Davis ordered Charbine released on his own recognizance.

  • Why no bail for this individual (I agree he should not have bail) but other violent crime perps in our area get bail or even low bail — even repeat offenders? Why the difference? Sincere question.
