Man arrested for breaking into Circle K on Archer Road, stealing cigarettes

GAINESVILLE, Fla. – Calvin Davonti Smith, 28, was arrested early yesterday morning and charged with burglary and petit theft after allegedly throwing a rock through the glass door of the Circle K on Archer Road, then entering the store and stealing cigarettes.

A Gainesville Police Department officer responded to the Circle K at 2320 SW Archer Road and determined that Smith had thrown a rock through the store’s glass door, then entered the business, hopped over the front counter, and stole three packs of cigarettes and two packs of Swishers. The incident was reportedly caught on the store’s video surveillance cameras.

Smith was found at the intersection of SW 16th Avenue and SW Archer Road and was reportedly in possession of the missing items.

Post Miranda, Smith reportedly said he did not break into the store and was walking to his house. He said he bought the cigarettes from a “dude on 20th.”

Smith is also facing a sworn complaint from an incident on April 26 when he allegedly stole a beer from the Publix at 203 NW 13th Street. The manager of the store did not want to pursue charges for stealing the beer but wanted Smith to be trespassed from the store. The officer detained Smith to check for warrants, and Smith allegedly ran into a wooded area. The officer charged him with resisting an officer without violence.

Smith has two felony convictions (one violent) and four misdemeanor convictions (none violent). He was released from the Alachua County Jail in March after serving 95 days for theft and resisting an officer without violence. Judge Walter Green set bail at $7,000.
