Man on probation arrested for possession of a firearm during investigation of armed disturbance

GAINESVILLE, Fla. – Kimon Marcus Miller, 35, was arrested early this morning for possession of a firearm by a convicted felon after deputies investigating an armed disturbance found a pistol next to his car.

At about 2:40 a.m. on June 29, Gainesville Police Department officers responded to a call about an armed disturbance in the 300 block of SE 2nd Avenue. Callers reportedly said the armed suspect, a black male, was in a red Chevy Impala with a Miami Heat license plate; officers found Miller sitting in a vehicle that matched that description.

Officers reported that Miller made furtive movements as they approached, specifically leaning toward the passenger side of the vehicle, followed by “an audible thud”; both the driver side and passenger side windows were rolled down. Officers reportedly gave multiple commands to Miller to show his hands, but he allegedly reached toward the floor of the car. When he was ordered out of the car, he got out but allegedly refused commands to put his hands up and walked away from officers before being detained.

Officers reportedly found a loaded black handgun on the ground outside the passenger side window of Miller’s vehicle and reported that Miller’s vehicle was the only vehicle near the firearm and Miller was the only occupant of that vehicle.

Post Miranda, Miller reportedly said he had not possessed the gun and that he’d had a passenger in his vehicle that he did not know and could not or would not describe. He reportedly said the unknown passenger tried to sell him the gun, pointed it at a woman, and left the gun near his car. He reportedly later admitted to possessing the gun and said his fingerprints and DNA would be found on it because he had handled it earlier in the night. He reportedly denied throwing the gun out of the vehicle and continued to insist that his passenger had left it there.

Miller is on probation for multiple felonies out of Georgia, including aggravated assault with a deadly weapon and possession of a firearm by a convicted felon; although his address is listed in Hawthorne on his arrest report, the Department of Corrections lists an address in Orlando as his verified permanent address.

Miller has been charged with possession of a firearm by a convicted felon and resisting an officer without violence. Judge Jonathan Ramsey set bail at $52,500.

      • i to was there he had no clue as to why officers was running to his car guns drawn with flash lights blinding him. and he didnt resist he didnt even know what was happening he was in shock. and he was leaning down to put on his shoes and grabbed his phone to start recording the scene he got out the car barefoot to show he was trying to put his shoes on

        • He should get mandatory 5 years in prison for being a felon with a gun…when will these felons learn? Incarceration works!

    • windows was not down as his A/C was on her rolled driver window down as they were approaching his vehicle i was a witness i saw everything the officer is lying the gun was found thru a gate where to people were standing prior to where he had just pulled up to in a parking garage to exit and go home

  • Should add tampering with evidence also, he attempted to discard/conceal the firearm. Good job GPD for catching him and not putting up with his bs.

  • im his brother and when they allowed me to take his car home only the driver window was down and his air conditioning was on the officer smiled at the fact that he was on probation because they knew they could take advantage of the situation. and say whatever and they would believe officers over a felon. system is rigged but i will also testify on his behalf.
