Man on probation arrested for possession of firearms including AR pistol and Glock “switch”
Staff report
GAINESVILLE, Fla. – Xavier Lamarious Kellogg, 19, was arrested on June 27 for violating probation, and the next day he was charged with two counts of possession of a firearm by an adjudicated delinquent under the age of 24.
Kellogg has been on probation since May 2022, when he entered a plea of nolo contendere to attempted aggravated battery with a deadly weapon and possession of a firearm by an adjudicated delinquent and was sentenced as a youthful offender to two years of house arrest, followed by four years of probation, by Judge Phillip Pena, who withheld adjudication of guilt.Â
Kellogg previously violated probation three times and served some time in jail earlier this year after the second violation; however, a month after his release, he violated the terms of his probation again by failing to attend mental health treatment sessions.
On June 27, Probation and Parole officers reportedly went to his apartment to conduct a warrantless probation search after viewing a video of Kellogg handling two firearms, and Gainesville Police Department (GPD) officers accompanied them but remained outside the apartment.
The Probation and Parole officers reportedly found a firearm, took a picture of it, and notified the GPD officers, who obtained a search warrant for the apartment. The Probation and Parole officers also turned Kellogg over to GPD officers, who took him into custody for violating probation.Â
When the search warrant was executed, officers reportedly found an AR pistol, two loaded AR magazines, a 45 caliber bullet, a .40 caliber bullet, firearm accessories, and a Glock “switch” that makes a pistol fully automatic. All of the items were reportedly found in Kellogg’s bedroom, near his wallet, identification, and paperwork in his name.
Kellogg was convicted of burglary of a vehicle when he was 14 and charged as an adult when he was 16 after he was arrested in connection with a February 2022 shooting at Pavilion on 62nd Apartments. In addition to the most recent charges, his probation officer reported that he gave the probation officer incorrect information about which room he was staying in and is $467.43 in arrears on monthly court costs payments.
Kellogg is currently being held without bail for violating probation, and Judge Jonathan Ramsey set bail at $125,000 on the new charges.
Articles about arrests are based on reports from law enforcement agencies. The charges listed are taken from the arrest report and/or court records and are only accusations. All suspects are innocent until proven guilty in a court of law.Â
Time for the Feds to get this 💩 on a machine gun charge. Our local State Attorney and judges can’t be trusted with proper sentences.
I know if I had a machine gun the Feds would sure as the world, put me in Federal prison.
You bet they would. However, in this new world of authoritarian equity injustice logic is absent.
Another day, another headline, of man on probation or man with a felony arrested with firearms. I wonder if their parole officers aren’t doing enough to let them know, they can’t go around ‘strapped’ anymore?
This turd head is laughing at the system, another lying hypocrite that thinks he can just lie his way out of trouble and go about his freedom. lock this POS up and let him enjoy several years of free prison food and a nice cozy cot to sleep on and think about the mistakes he’s made as a dumb lying criminal.
Good job, parole/probation team! It is better that guy is inside…..
Thugger Lives Don’t Matter (TLDM).
He is a good boy. Just got caught up with the wrong crowd…
At only 19 years old this so many charges against him for violating probation it’s absurd that he keeps getting put on probation. He’s violated his probation at least 5 times. Now they’ve caught him with weapons. Prison is where this sad, waste of a life belongs.
