Man on probation for DUI arrested after officers allegedly found him passed out in his car at University and 13th

GAINESVILLE, Fla. – Gerald Dorrie Fleming, Jr., 34, was arrested early this morning and charged with driving under the influence and resisting an officer after officers reportedly found him passed out in his car in a turn lane at the intersection of University Avenue and NW 13th Street. He was sentenced in September to one year of probation after being found guilty of driving under the influence in August.
At about 1:39 a.m., a Gainesville Police Department officer driving through the area noticed the vehicle stopped in the turn lane; because the headlights were not on, she believed it might be disabled. However, as she approached, she reportedly found that both the driver, later identified as Fleming, and the passenger were passed out. She reported that the vehicle was on and the transmission was in Drive. Meanwhile, a passing driver had also called a stopped vehicle with a driver who was passed out.
The first officer reportedly smelled alcohol and put the vehicle in Park before waking Fleming; she then instructed him to turn the vehicle off.
By the time the second officer arrived, he reported that Fleming had fallen asleep again. The second officer woke Fleming and asked him to get out of the car; he reported that Fleming thought he had been pulled over, wanted to know why, and did not seem to know that he had been passed out.
Fleming reportedly said he had been in a Midtown bar and was on his way to Turkey Creek to take his passenger home. He reportedly performed poorly on field sobriety exercises and was arrested for driving under the influence.
The officer reported that when he placed Fleming under arrest, his “demeanor completely changed” and he became hostile and made profane and racist accusations against the officer. He also allegedly refused to get into the patrol car. Once at the jail, Fleming allegedly pulled away from the officer repeatedly and refused to sit in the chair in the breath test room. His breath reportedly measured at .147 and .146 g/210L.
Fleming has been charged with driving under the influence, violating driver’s license restrictions, and resisting an officer without violence. He was previously arrested on August 5, 2023, after crossing the center line, driving over a curb, and being found passed out in his car on Museum Road on campus. He entered a plea of nolo contendere to the charge and was sentenced to one year of probation; his driver’s license was suspended for six months, and he is not permitted to possess or consume alcoholic beverages. He has also been charged with violating probation in that case.
Judge Robert Groeb set bail at $150,000 on the new charges.

Yep, still acting like a child. Sooner later his drunk driving and drinking is going to get someone else killed. Drunk drivers rarely are the ones killed in DUI crashes.

Thanks Judge Groeb! I can’t imagine what this guy’s conversation with his car insurance agent will sound like.. 2nd DUI in 6 months…heck he most likely does not have insurance…who am I kidding..
Well, if he isn’t just a poster boy for drunk divers! Still so drunk he can’t even open his eyes yet he was driving a car. These people are so self centered, so disrespectful of other people and their right to life that they persist in driving drunk and risking other people’s lives. Drunks ought to get hefty prison sentences for driving drunk, not “rehab” not “community service” but prison. They are the most disgustingly self centered people on the planet they think they’re right to get drunk and drive trumps our right to life.
How are you going to judge someone you don’t even know. I really hate when people like you come judge a person without even knowing what they go through. And I’m not saying he’s in the right. But you to call him things when you don’t know him is so annoying.
He was arrested for driving drunk. That’s what I know about him. Driving drunk endangers other people’s lives thus, to drive drunk and risk other’s lives is murder and ought to be treated as such.
