HSPD Chief reinstated, required to reimburse City for overpayments

HIGH SPRINGS, Fla. – High Springs Police Department Chief J. Antoine Sheppard has been reinstated after a two-week administrative leave and an internal affairs investigation that found he improperly assigned extra duty details and was overpaid.
Sheppard was placed on administrative leave on June 23, but the complaints were not made public until the investigation was complete.
The allegations
A June 26 letter from City Manager Jeremy Marshall notified Sheppard that the City had found probable cause supporting allegations that he had failed to advertise extra duty details to officers; had failed to honor requests for extra duty details and had taken those details himself; had scheduled himself for CRA extra duty hours on Mondays and Tuesdays, when CRA district businesses are mostly closed; had received significant overpayments for extra duty details and had failed to alert the City of this; had received significant overpayment for Paid Time Off (PTO) and had failed to alert the City of this; had falsely recorded extra duty hours on his timecard; had falsified CRA activity logs and misrepresented his presence in the City during some of those hours; had used 234 of 235 CRA extra duty hours in only three months; had improperty collected extra duty pay during business hours, resulting in double compensation; and had failed to ensure that CRA activity logs submitted by other officers were accurate.
At a hearing on July 1, Sheppard argued that the City’s policy on assigning extra duty details was outdated and superseded by the Collective Bargaining Agreement (CBA) between the City and the North Central Florida Police Benevolent Association.
At the hearing, the City stated that the Chief is not an “employee” under the CBA and is excluded from the bargaining unit, so the terms of the CBA do not apply to the Chief, and City policy applies; the City also argued that Sheppard’s method of assigning extra duty details “was contrary to the express terms” in the CBA, which says these details are to be assigned by rotation on the basis of seniority.
A second hearing on July 6 was scheduled to address the issues Sheppard raised regarding the CBA.
Sheppard’s response
Sheppard’s written response, dated July 6, denied the allegations and stated that he believed the investigation was prompted by his decision to discipline an employee who was represented by a local attorney, who then submitted “an extensive series” of public records requests about his administration. He also wrote that he opposed reductions in the City’s police department and was informed by Marshall that “at least one Commissioner was unhappy” with the information he presented.
Sheppard pointed to his 25-year history with the City, including seven years as Chief. He said the practice for assigning extra duty details has been “openly utilized for years without objection,” including under previous Chiefs Holley, Antonio, and DeCoursey, Jr., dating back to at least 2013. He said he works extra duty details “when necessary to ensure that all scheduled patrol hours are covered.”
Sheppard wrote that he was “completely unaware of any alleged payroll overpayment” until the July 1 hearing and said that if he had been notified, he would have “immediately cooperated to determine the cause and resolve the matter.” He added that the City’s new payroll software has resulted in “recurring and well-documented problems affecting multiple employees throughout the organization.”
Regarding the allegations that he had billed time to the CRA while not in the district or even in the City, he pointed out that his equipment does not have GPS or Automatic Vehicle Location technology to continuously track his movements, so the locations provided in the complaint were based on communication with dispatchers; he wrote that the dispatch system (CAD) “continues to display that last recorded location until another CAD event updates it. That can result in a CAD sheet that appears to show me [at] a certain location for more than 24 hours and [in] some cases for days, which is clearly not the case.”
Regarding the allegation that 234 of 235 CRA hours were used within three months, Sheppard wrote that this is factually accurate but does not constitute misconduct; he wrote that historically, CRA patrol hours have been concentrated during the holiday shopping season, primarily November through January.
Sheppard wrote that he has “historically utilized flex time rather than charging accrued leave for every variation” in his work schedule, and this “has never previously been identified as improper, inconsistent with City practice, or in violation of any written policy.” He accepted responsibility for the lack of “oversight” of several identified issues with CRA activity logs but said there was no intent to submit false information.
Conditions of reinstatement
Marshall notified Sheppard today that he has been reinstated, effective immediately. Marshall also issued Final Written Warnings for Sheppard’s failure to follow City policy in assigning extra duty details and his failure to ensure that extra duty compensation requests are accurate. Marshall wrote, “The available evidence was insufficient to support the remaining grounds set forth in your Predetermination Hearing Notice.”
Sheppard will be required to enter into a payment plan by August 1 to repay the City for overpaid PTO and any overpaid Extra Duty compensation, after an audit is completed to establish how much was overpaid.
Conditions of Sheppard’s reinstatement include an expectation to accurately record and report all time worked and all PTO taken, and he will not be eligible for extra duty assignments unless preauthorized by the City Manager. Marshall also clarified that Sheppard is not entitled to flex time, but he is entitled to compensatory time. He is expected to monitor his department’s payroll submissions on a biweekly basis to ensure correctness.

Wendy, you are absolutely correct. Antoine has a contract, much like the city manager does. His salary is specifically outlined in his contract and he DOES NOT have the ability to earn overtime.
Antoine’s actions constitute grand theft, falsification of official records/documents and acceptance of unauthorized compensation. Antoine he needs to be held accountable.
So much for Antoine serving his community honorably, ethically, and with integrity!
His position IS a salaried position, yet he accrued overtime while the fire chief who was also a salaried employee picked up shifts that required similar coverage received no overtime. Yet the police chief claims PBA bargaining granted him the OT ability of which his position isn’t part of. But nope nothing to see here.
So much for Mr. CanDoNoWrong. This should have never been handled by internal investigation. This should have been turfed to FDLE as an independent outside investigatory body. So many other officers, deputies, and troopers are getting arrested for double dipping. Why would he agree to reimburse the city if he didn’t commit any wrong doing?
It’s because he did. And as the Chief of Police, he’s to be held to the highest account in his department and as a department head of the city. This is an example of poor leadership at the City of High Springs. Any wonder why it keeps happening? It’s because no one sets the standard. It was his job and he failed. And so many of you backed him like he can do no wrong. You know who I’m talking about “Pastor”.
This is gross. Sheppard is compromised by the lure of the dollar. He has no moral standing. Someone in the city should defer this for FDLE oversight.
Sounds a little like Chad Scott did when he was a deputy. Doctoring up O.T. he was fired for that. Grand theft anyone.
Why wasn’t he fired?
Also when do we get the full story of the Grace Marketplace director scandal?
He should have been fired, arrested and decertified by FDLE.
I’m sure he not only met with the NAACP, but he was fully prepared to use the “race card” if he felt he was backed in a corner.

This is vintage Antoine. As you can see, he lacks any sense of ethics and integrity!!!
Sheppard might want to start job shopping. His days in High Springs are numbered.
They can’t keep a Chief.
It’s only a matter of time before this is forwarded to FDLE and the State Attorneys Office. Antoine’s actions violated at least three of FDLE’s moral character violations: grand theft, falsification of official records/documents and acceptance of unauthorized compensation.
Antoine should be looking over his shoulder for bigger and better repercussions.
Will the city keep him as chief when FDLE revokes his certification???
A complete explanation needs to happen in our community, where facts matter more than an emotionally driven crowd. What’s been happening in High Springs is exactly why outside agencies exist, separate from whatever was planned at City Hall on Tuesday night. I’m not going to become what that large, opinionated group in black T‑shirts turned into — just an emotional crowd. I think the proper authority, like FDLE, should take over and get everything out in the open. If charges need to be made, then make them, but only after a real investigation.
It sounds like he didn’t completely understand the extra duties rules and worked the hours himself. You can be salaried and earn extra pay for different duties. This is lot of foolery and disguised hate.
The city manager noted that Antoine, “had improperly collected extra duty pay during business hours, resulting in double compensation.” Even the most simple minded individual knows that conduct like this is improper and illegal!!!
This is known in the police world as “double dipping” and is theft; grand theft if over a certain dollar amount.
Police officers are supposed to be ethical and possess a level of integrity beyond reproach; especially someone in the position of chief of police.
Antoine lacks both of these traits.

Unfortunely he has been at High Springs Police Department for his entire career, 25 plus years. These overtime rules have been in place forever and never were meant for command staff to use since they are on a salary instead of hourly pay. He will have a hard time explaining away rules that have been in place, being stupid, or nieve, or uneducated about policy doesn’t say much for his character or ability as a leader. But gey, maybe his buddy Chad can give him command spot at ASO.
How much money are we talking about that he has to pay back?
I think he finally got caught and should be fired…
He got paid for work he didn’t do and that’s stealing…why else would he have to pay it back?
He should be fired and lose his pension if he gets one for this…

High Springs is a speed trap disguised as a city. Our family and friends drive around it now and we don’t shop at its businesses. How many dollars of revenue have we shifted to businesses on Newberry or Archer Rd? Anyone’s guess. Was that this Chief’s doing? I don’t know…
How can a certain demographic of supporters see nothing done wrong here? This is a racist group who think any laws interfering with them getting their ill gotten gains ate for other races instead.
Antoine has progressed his entire career playing the race card. It didn’t hurt that his cousin, Byran Williams was a long term High Springs mayor/commissioner.
