Juvenile charged as adult for carrying concealed firearm in March 26 shooting incident

GAINESVILLE, Fla. – Charles Emmanuel Smith, 15, has been charged as an adult with carrying a concealed firearm without a permit in connection with the March 26 shooting at 1024 W. University Avenue.

Emanuel Leon Baker III, 18, was previously charged with attempted murder in the same incident after allegedly shooting the victim in the chest with a .45 caliber handgun.

Surveillance video from the Chevron gas station reportedly captured the entire incident; Smith reportedly walked up to the victim in a crowd and forcefully bumped him, then threw his Checkers cup at the victim. As the victim staggered backward and the crowd scattered, Baker allegedly pulled a handgun from his waistband and shot the victim. Baker and Smith then fled north on NW 11th Street.

Gainesville Police Department officers made contact with the two teens as they fled toward Baker’s vehicle and reportedly found a Glock 17 in Smith’s pants. A 9mm handgun was also reportedly found in the victim’s waistband. After Baker’s vehicle was towed from the parking lot, officers reportedly recanvassed the parking lot and found a .45 caliber handgun on the ground where the vehicle had been parked.

Both teens reportedly denied shooting the victim. A gunshot residue test was reportedly negative for Smith but positive for Baker.

Smith has a juvenile history; Judge Thomas Jaworski set bail at $25,000.

  • I love how the anti gun left wing keeps saying we need more laws to stop gun violence.
    We have laws on the books that states under 18 can’t possess a gun, also laws against felons from having a gun so please tell why you read the papers every day a felon was arrested with a gun don’t they know it’s illegal for them to have one
    The truth is no matter how many laws you pass these thugs, drug dealers, gang members, criminals are not going to obey them it only infects law abiding citizens
