“Time will tell”: School Board votes 3-2 to approve controversial CFO candidate

GAINESVILLE, Fla. – At today’s School Board of Alachua County meeting, the board voted 3-2 to approve a CFO candidate after Member Janine Plavac questioned the candidate’s qualifications; Member Leanetta McNealy also voted against the candidate, saying, “Time will tell.”

Public comment

During public comment on agenda items, one woman said she was concerned about the candidate, current Budget Director Michael Reneke, and she urged Superintendent Kamela Patton to make sure the CFO has “the highest possible credentials.” A man said people should “have the same energy when it comes to the CFO of Florida, who also doesn’t have any certifications or college degrees but somehow managed to become the Chief Financial Officer for the entire state.”

List of personnel assignments pulled from the consent agenda

During the adoption of the consent agenda, Plavac asked to pull a list of personnel assignments for discussion; the list included the promotion of Reneke from Budget Director to Chief Financial Officer (CFO). 

Motion

When the agenda item was introduced, Assistant Superintendent for Human Resources Debbie Terry recommended approval of the personnel list. Member Tina Certain made a motion to approve the personnel list, and Member Sarah Rockwell seconded the motion.

Plavac said she would like to hear the Superintendent’s reasons for hiring Reneke as CFO, but Chair Thomas Vu first asked Board Attorney David Delaney what the statutes say about the Superintendent’s authority to make hiring decisions.

Board Attorney David Delaney: “The Superintendent has the authority to select the individuals to fill those positions approved by the board.”

Delaney said Florida law “makes it very clear… The Superintendent has the authority to select the individuals to fill those positions approved by the board… The Superintendent is responsible for the performance of the district, therefore the Superintendent gets to pick the team members who produce that performance.”

Superintendent Patton: “He demonstrates initiative to identify potential problems for improvement and takes action, has already driven change around processes. He’s an effective communicator. He looks for global solutions… He’s been promoted based on his abilities.”

Superintendent Patton said Reneke has “the knowledge, skills, and expertise to do this job, with his 26 years of experience in fund-based accounting, which is what we use here,… having been a Vice President of Administration, a CEO [sic] for over 12 years — that’s over a decade. He was able to assume responsibilities from the day he got into Alachua County Public Schools… He demonstrates initiative to identify potential problems for improvement and takes action, has already driven change around processes. He’s an effective communicator. He looks for global solutions… He’s been promoted based on his abilities.” She said he is “certified in the Federal Office of Management and Budget” and has trained others on audit and cost principles. She said he is also certified in contract administration, contract management, procurement, and negotiations by the State of Florida. She concluded, “He’s done a very good job, and we’re looking forward to extending his skill set to be our CFO.”

Board Member Leanetta McNealy: “I’m not satisfied, and I cannot… go along with what this board wants to do in approving the recommendations.”

McNealy said she understood the statutory responsibilities of the Superintendent and the board, but she thought the district should reopen the recruitment for the position “if we are not going to follow the job descriptions.” She concluded, “I’m not satisfied, and I cannot… go along with what this board wants to do in approving the recommendations… I felt that I needed to publicly say why I am not in favor of this individual at this point.”

Reading from statutes, Plavac said a school board “may only reject the Superintendent nominee for an employee position for ‘good cause.'” She said that Florida court and Attorney General opinions have stated that “good cause” can refer to a candidate’s failure to meet minimum educational qualifications, lack of required professional experience, or an inability to perform the necessary work. 

The job description for the CFO lists the following qualifications:

(1) Masters degree from an approved accredited educational institution with specialization in public or business administration, finance, or other acceptable field; or Bachelors degree in accounting or other related field and Certified Public Accountant (CPA) credentials.
(2) Minimum of ten (10) years progressively responsible administrative and supervisory experience.

Plavac asked why the certificates mentioned by Patton were not listed on Reneke’s resume, and she said the largest budget he has managed was $154 milion, compared to over $600 million for the school district. Describing a lack of records documenting the hiring process, Plavac concluded, “It appears reasonable for the Board to request confirmation that all required procedural steps were completed and documented before taking final action.”

Patton said the current financial consultant, Judith Marte, supports hiring Reneke, and she asked Delaney whether Reneke “fits into how our job classification is written.”

Board Attorney Delaney: “It’s my opinion… that the candidate qualifies under the experience pathway for this position.”

Delaney said, “The job description, as it’s written, has two pathways to qualify for the position. It could be by education and having a particular set of degrees; … you can also qualify for this position with 10 years of experience. It’s my opinion… that the candidate qualifies under the experience pathway for this position.”

Certain said she initially questioned Reneke’s hiring, but after meeting with him to discuss some questions about financial statements, “I support the recommendation.” She also said the Superintendent does not need to justify her hires to the board and “accountants are hard to come by.” She said her meeting with Reneke was “promising,” and she hoped he could save her time that she has spent in the past, asking questions about financial statements. 

Rockwell asked Delaney whether, in his legal opinion, he thought there was good cause to object to hiring Reneke, and he said, “No, ma’am.” He added that he believes “board members are required to… support a recommendation unless good cause exists” He said board members can ask questions, “but ultimately, I think the law says that you should only vote against a good candidate when good cause is not present.” Rockwell responded, “Thank you, Mr. Delaney, I fully intend to fulfill my statutory obligation.” She also praised Patton for overcoming a $20 million budget deficit, adding, “I do not for one single second believe that Dr. Patton would recommend an appointment for CFO that would undo that tremendous amount of work.”

Vu said he has found Reneke to be “very intelligent, very capable. I found him to be experienced… I was incredibly impressed.” He said board members “need to continue to stay in our lane.”

McNealy said she still thought it was a problem that Reneke does not have the degrees listed in the job description, “but, you know, time will tell.”

Plavac: The job description requires both qualifications, not one or the other

Plavac said she asked “a senior counsel at a billion-dollar tech firm” to look at the job description, and his opinion was that the way the job description is worded, both qualifications are necessary, not one or the other, because there is no “or” in the job description. She concluded, “It is irresponsible of us to vote for this person.”

Superintendent Patton: “It is not that we have had 13 people sitting here with high qualifications and that we’re unfairly choosing him. He has been the best that we have had.”

He has been the best that we have had.” She said that since he was hired as Budget Director, she has observed his “incredible ethical behaviors [and] his leadership, that we’ve been lacking in that department.”

Patton concluded, “It is my job to assemble the team, and hold me accountable. If it doesn’t work out, then that is on me… You hire me and hold me accountable. I hire my team, and I’m very happy to have Michael be part of our team.”

Plavac said, “Yes, he will declare himself, but I don’t think he’s qualified, and I want to put it in the record. I think it’s a huge mistake.”

The motion to approve the list of personnel assignments passed, 3-2, with McNealy and Plavac in dissent. 

  • I suggest the Board start hiring people off the street to fill their shortage of bus driver and teaching vacancies given their low standards. Patton owns most of this group and she’s made it clear; they’re afraid of her because she has the financial means to sue the District. Patton certainly owns Certain, and Vu is just part of the package. Rockwell hasn’t the intelligence to understand she’s just a pawn in the whole mess to gain a majority vote.

    On the other hand, maybe we’ve got this all wrong. Maybe the Board members all have special relationships with Reneke. Based on her deferential statements, one might especially conclude this of Rockwell. Think she ever takes that mask off? Vu will always side with whatever his master, “Certain,” tells him and, like a lapdog, is always seeking Patton’s approval. He just makes it difficult to determine who he’s trying to please from meeting to meeting.

    To those who think this is acceptable – these are the results you get when you elect people who lack the education, the experience, or the common sense to lead the school district. You’ve proven time and again you’re complete idiots.

  • Plavac:

    File ethics complaints with Tallahassee against Dr. Patton and those board members who approved his hiring to see what they have to say about this Controversial item being placed on the consent agenda (wrong process) and his lack of qualifications… they knew or should have known not to do this hire.

    Attach that excellent letter to the editor you wrote explaining the situation and his lack of qualifications…you already did the excellent work.

    Tallahassee and The Board of education are already not happy with with ACSB members Certain and Rockwell for their public comments about “Hulk Hogan and one less MAGA “ and “Charlie Kirk being an un educated white boy”, the rude way the board treated parents who want to speak before the board, among other things.

    Notorize the complaints, send it off to Tallahassee..The ethics board will notify them after they receive the complaint…

    it may take 6 months before they get to this, but maybe Tallahassee will not like the way they put this controversial hiring on the consent agenda and his lack of qualifications (things not on resume) and find that they knew or should have known not to do this hire…

    If they don’t like the way this went down, they can reverse this hire and remove those board members who voted for him and appoint new members… Tallahassee needs to step in!

  • Given the reasons of those in support of his promotion, is it any wonder this school district is in disarray? An attorney who can’t interpret the law, a board that won’t stand up to its employee, and an employee who has more meetings than quantifiable results.

  • Upon further reflection of this reckless action by the irresponsible Board:

    Plavac said a school board “may only reject the Superintendent nominee for an employee position for ‘good cause.’” She said that Florida court and Attorney General opinions have stated that “good cause” can refer to a candidate’s failure to meet minimum educational qualifications, lack of required professional experience, or an inability to perform the necessary work. Reneke definitely lacks two of the three.

    Patton said Reneke has “the knowledge, skills, and expertise to do this job.” If that is the case, then why is the District paying for him to go to school? How many principals or other personnel are she and the District offering to pay for to further their educational goals? I would suggest those employees sue the District if they have similar goals.

    I’d like to submit my application to the Board to replace that knucklehead Patton; I won’t alienate the employees, get rid of necessary personnel, nor employ my flavor of the month. I’ll do the job better than she does and save the district at least $50,000 through a voluntary reduction in salary. Let’s just see how it works for a year or two; if I cannot perform the job, hold me responsible.

    Next election cycle, I suggest voters hold this irresponsible Board accountable.

    • Good point about the continuing education. Will he be getting paid his upcoming undeserved, premium salary while he’s attending class since he won’t be performing the job he’s supposed to and supposedly qualified for already?

  • “Time will tell” and as Patton said, it’s on her and in fact that’s her job. A couple of things:

    Plavac insists that the 2 paragrapghs on qualifications both apply because they don’t have an “or” between them. OK, but it doesn’t have an “and” either. It is a poorly written and un-incipherable qualification, so both sides can use it as they wish.

    By statute this is Patton’s decision and while the SB should challenge what they question, this not their call. Good job by Plavac to raise it, but that’s the end of it. If the candidate is as good as those who spoke on his behalf say, this will soon be forgotten. If not, we all know who to blame.

    Oh yeah! Florida’s CFO, Blaise Whathisname?

    “Ingoglia was born in Queens in New York City, and attended Queens College, and Brooklyn College, he did not graduate.”

    • The job description does not say “or”. It doesn’t have to say “and” for both items to apply. In the English language, the correct interpretation when two items are listed as 1) and 2, then both apply. We missed out on a lot of great candidates who did not apply because they saw the two requirements and did not apply. If the requirements were actually meant to be “or”, then it should have been stated explicitly.

          • Well, that’s your opinion, but it is not a matter of opinion that you were wrong to claim the state CFO was elected. This academic high flyer – that’s sarcasm, he never got a degree of any kind past high school – was appointed by our perfectionist and strict governor.

            You are wrong on that and that’s a fact.

          • The CFO for the state of Florida is an elected position. If the position is vacated, the governor appoints a replacement.

      • You are correct and by covering for the superintendent the attorney set a harmful precedent by stating:

    • The requirement for state CFO is just that you get the most votes, so that is not a valid comparison.

  • Unfortunately, the job description intentionally uses the word “or” to allow the Superintendent to recruit more individuals for her team. There are many capable people who could perform the job, but few want to deal with her.

    • It’s my understanding that It doesnt say “or” for the qualifications… if it doesn’t say that, then it’s an “and”. If it’s “and”, then the applicant has to meet all the criteria to be hired.

  • The solution is obvious; the State Board of Education should recommend to the Governor the current SBAC be removed for cause, citing their failure to follow governing rules or at the very least, their own minimum requirements for the position – specifically Reneke’s lack of required qualifications. Meeting Patton’s personal eye-test shouldn’t be an automatic qualifier. Once a new Board is in place, they should fire this grifter of a Superintendent, replace her appointees, and reverse the “loyalty raises” granted to District personnel at the expense of our schools.

        • Uh Bull, “Daddy” appointed the CFO for the state of Florida who has no college degree of any kind. He can’t get it together to check qualifications for a 5 member board for the GRA or to replace them as their terms expire.

  • The superintendent is more powerful than the School Board because of those who vote for her extension, the same group that is racist and discriminates against religion, color, and free speech. Dr. Patton is a millionaire and believes that the citizens of Alachua share the same mindset as the Colliers. Most of our residents are working and middle-class, not wealthy like the people of Naples. She should focus her efforts on fixing the mess at schools and addressing the consequences of the cuts she made last May. Those 20 million she “saved” will be offset by what she will have to pay back.

    • I’m I the only one who recalls that Dr. Patton stated that she would only extend her initial contracted time for a few months “if needed”. Because of the inaction of the Board to do their job and hire a new Superintendent, she rather enthusiastically said that she was willing to extend her contract for more that a year more.

  • Thank you Ms. Plavac for trying to bring forth some transparency for the school district. Time will tell, grab the popcorn and a comfy chair, the fun is only starting. The fallout from this decision will be interesting to see…

    Page 2 of the above job description link specifically shows how job descriptions are changed when current applicants are unable to meet the existing requirements. School board very clearly revised the qualifications to state “preferred”. They had to make this change because the applicants were unable to meet the existing listed requirements.

    They have very clearly always operated under the assumption that all of the listed qualifications are required or else this entire meeting item from 2023 would have never been necessary.

    It’s always been ‘AND’ and never was ‘OR’. Dishonesty runs rampant at our schools!

    • I should have been more clear. The 2023 job description change I referenced above was not for the CFO position…that change was for bus, ESE attendants. The CFO position was never changed to include “preferred” for any of its qualification. My point is that unless otherwise noted (ie “preferred”) it was always inferred that all listed qualifications were required up until the current CFO hire and the attorneys accompanying odd opinion.

    • The job description also lacks any “if/but” clauses that would permit exceptions to the stated requirements. Patton’s appointments of individuals who fail to meet these minimum standards, she is effectively bypassing established protocols. This practice suggests that her personal preference is being positioned above the governing authority of the Board and implies her authority supersedes any objections they may have.

      Her acting with thoughts of impunity may be an underlying reason she left her last employ.

      • She’s probably just doing what she thinks she has to in order to patch up the district before she’s soon gone for good. I’m pretty sure everyone knows the district cannot attract high level talent with its current board. They couldn’t even replace her if they wanted to right now. I’m not saying she’s innocent but I’m definitely putting full blame on the board for these (lack of) hiring issues.
